The ProCME Group respects the privacy of its customers and suppliers. This Privacy Policy describes who we are, the purposes for which we may use your data, how we process them, with whom we share them and how you can contact us and exercise your rights.

 

 

1. Who are we?

Your data will be processed by the ProCME Group, hereinafter referred to as "ProCME" or "us". This company is the controller within the meaning of the General Data Protection Regulation.

2. Why we need your information?

ProCME will process your personal data for the following purposes:

 

  • Customer and potencial customer management

The processing of your data is necessary for the performance of the agreement to be concluded between you and ProCME, or to carry out the pre-contractual steps at your request. If you do not provide your data we will not be able to provide you with the services requested or contracted. Your data will be kept for this purpose during the period necessary for the exercise of the respective rights.

Customers personal data may be processed by ProCME for the purpose of litigation management. The legal basis is the existence of a legitimate interest on the part of ProCME and the data will be kept for the period necessary for the exercise of the respective rights.

  • Marketing

ProCME may process your data to send you information about its products and services. This data processing will be carried out only with your consent, provided at the time or by means of a form. If you consent, you will receive marketing communications by email. Failure to provide your personal data (name and email) prevents ProCME from sending commercial communications. You may at any time object to this data processing.

Your data will be kept for this purpose during 6 months after the last contact (in the case of regular contacts) or 1 year (in the case of sporadic contacts).

 

  • Management of complaints and contacts received by ProCME

You can send to us, at e-mail address apoiocliente@grupo-procme.com or phone number 808 50 10 10 suggestions or complaints regarding the services provided by ProCME.  Your personal data will be processed on the basis of the legitimate interests of ProCME and on your consent. ProCME collects your data to analyse and resolve the situation underlying the your suggestion or complaint.

Your data will be kept for this purpose during the period necessary for the solution of your question, during a maximum of 10 years.

 

  • Supplier/subcontractor management

The processing of your data is necessary for the performance of the agreement to be concluded between you and ProCME, or to carry out the pre-contractual steps at your request. Should you not provide your data we will not be able to fulfil the contractual obligations entered into. Your data will be kept for this purpose during 10 years.

Suppliers personal data may be processed by ProCME for the purpose of litigation management. The legal basis is the existence of a legitimate interest on the part of ProCME and data will be kept for the period necessary for the exercise of the respective rights.

The data of ProCME suppliers, in particular of employees, may be communicated to ProCME customers for compliance with legal or contractual obligations.

 

 

3. Will my information be shared with others?

Your personal information may be disclosed:

  • Within the scope of the ProCME Business Group. Group companies are specialised by areas of activity and services requested of one company may be processed by another, more appropriate to the activity in question. It should also be noted that there is a logic of shared corporate services within the group.
  • Third party service providers / ProCME subcontractors. If you are our customer or supplier, your personal data may be processed by companies subcontracted by ProCME, particularly for website housing, email, etc. Only the personal data necessary for the provision of the service in question are provided to these companies.

 

Personal data may also be accessed by the ProCME Group’s internal and external auditors, with the guarantee that they will be kept confidential and will not be used for purposes unrelated to the audits.

Your data will primarily be processed within the space of the European Union. Any transfer of data outside the European Union shall be subject to adequate safeguards.

 

 

4. What are my rights?

At any time, you can ask us for:

  • Access to information we keep about you.
  • Rectification of inaccurate or incomplete information.
  • Erasure or limitation of the processing of your personal data.
  • If the processing depends on your consent or agreement and this is done by automated means, you are entitled to send the personal data previously provided, in a structured manner commonly used in a computer-readable format.

 

Your requests will be treated with special care so that we can ensure the that your rights are safeguarded. You may be asked to furnish proof of your identity to ensure that the personal data is shared solely with the data subject.

You should bear in mind that in certain cases (for example, due to legal requirements) your request may not be satisfied immediately.

In any case, you will be informed of the measures taken to this end, within one month of the time the request is made.

You are also entitled to submit a complaint to the National Data Protection Commission www.cnpd.pt

 

  • Right to access

The personal-data subject shall be entitled to obtain from ProCME confirmation as to whether the data concerning him or her are being processed or not, and, if so, to access the personal data and the information laid down by law.

Should you want more than one copy of your personal data that is being processed, ProCME subjects the service to payment of a fee to cover administrative costs.

 

  • Right to rectification

The personal-data subject is entitled to obtain from the ProCME company, without undue delay, rectification of inaccurate or incomplete data concerning him or her.

 

  • Right to data erasure (“right to be forgotten”)

The personal-data subject is entitled to obtain from the ProCME company erasure of personal data concerning him or her without undue delay and the latter is obliged to erase the personal data, without undue delay, where one of the following motives applies:

- The personal data are no longer necessary for the purposes for which they were collected or processed.

- The subject withdrew his or her your consent to the processing of data (in cases where the processing is based on consent) and there are no other grounds for the said processing.

- The subject objects to the processing and there are no legitimate prevailing interests that warrant the processing.

 

  • Right to restriction of processing

The data subject is entitled to obtain from the controller restriction of processing where one of the following applies:

- Challenge to the accuracy of the personal data during a period enabling ProCME verify the accuracy.

- The processing of the data is unlawful and the data subject objects to the erasure of the personal data and requests the restriction of their use instead.

- ProCME no longer needs the personal data for processing purposes, but these data are required by the data subject for purposes of declaration, exercise or defence of a right in legal proceedings.

- The data subject has objected to the processing until it is found that the legitimate grounds of the controller override those of the data subject.

 

  • Right to data portability

If the processing depends on the data subject's consent and such consent has been provided by automated means, the data subject is entitled to the receive personal data concerning him or her that they have provided to ProCME in a structured format of current use and automatic reading.

 

  • Right to objection

In cases where the data is processed for the purposes of the legitimate interests pursued by ProCME; or 2) the data processing is carried out for the purposes of direct marketing or 3) definition of profiles, he or she may also, at any time, object to the processing of their personal data.

 

 

5. Can I revoke my consent at a later time?

If the consent is legally required for the processing of personal data the data subject is entitled to withdraw consent at any time, although that right undermines neither the lawfulness of the processing performed on the basis of consent previously given nor further processing of the same data, based on another legal basis, such as fulfilment of the contract or legal obligation to which ProCME is subject.

6. How does PROCME use cookies and similar technology?

To provide better service to users, we use cookies, that is, small text files that are placed on your hard drive by a Web page server. This technology is used by ProCME primarily to:

  • Let us know who our visitors are and  provide a better, more secure and personalised service.
  • Ascertain the performance of our sites with a view to updating and improving them, to meet the expectations of our customers. Every visitor is assigned an individual cookie, thus ensuring the privacy and security of the data. Submission of statistical data is done in an aggregate manner that does not allow identification of the visitor individually.
